Michael Michael, a five-year-old male, just diagnosed with hearing loss and a speech disorder, has not learned to speak properly and is working with a speech therapist three times a week. Michael does not show any progress in learning letters or numbers. His parents are worried that he might be labeled in school and not allowed to participate in regular classroom activities. Michael is scheduled to start kindergarten in a month and the school psychologist wants to test him to see if he should be placed in special education classes. After speaking with Michael’s parents, it is found that he is an only child and does not play with children in the neighborhood. Although, he has occasionally play dates, Michael struggles to make friends. Due to children not responding to Michael when he tries to talk to them, there is little contact, causing Michael to be socially immature. To begin a plan to help Michael with his learning and social skills, there must be an understanding to why he has a hearing disorder as well as seeking strategies to support him in school. Use the definition laid out in IDEA to describe Michael’s hearing disorder and the competency based individualized strategies for supporting him in a school setting. According to (Heward, 2013) p. 313, Michael is suffering from deafness. His hearing loss is so severe that he is impaired in processing linguistic information through hearing, with or without amplification, which causes an effect on educational performance. Most special educators distinguish between children who are deaf and those who are hard of hearing. Michael is deaf and cannot use hearing to understand speech. If Michael was able to hear, he would be able to understanding and interpret speech without using any special device or techniques. Due to Michael’s deafness, a hearing aid, would not allow him to understand speech through the ears alone. Most deaf people use their vision as a primary sensory mode for learning and communication. Michael is unable to make friends and his  disabilities interfere with his social development. As a person that has worked with disabilities I feel that part of this is because he is an only child and when he has play dates Michael doesnâ €™t understand them completely and because of his hearing and language it is also because the people that come over the play have a hard time understanding him. It is possible that Michael is socially immature because he can’t be understood and is not at the age mentally as the rest of the children his age. I feel that if Michael had a sibling either younger or a couple years older he would have a better understanding of how to make friends because he would be around someone daily it would also help him to grow and become more mature. Since he is starting Kindergarten his year it would be great if he could get meet some of the kids earlier and make a friendship or play date with some class mates so he doesn’t get over whelmed as easy about the change. A hearing impairment can be considered a culture difference for Michael because he shares a language with other people that have this common issue and as he gets older social practices as well. Per our text many deaf people do not view themselves as disabled and consider hearing loss and inappropriate and demeaning term because it suggests a deficiency or pathology. It also refers to people in the individual way people who identify the Deaf culture prefer term such a teacher of the Deaf, school for the Deaf and the Deaf person (Hewa rd, W. L. 2013) Deaf culture is shared language (in the U.S. American Sign Language ASL) social practices, literature and beliefs of the Deaf community: members do not view deafness as a disability. One way that communication impacts â€Å"Deaf Culture is what individuals with disabilities identify with. As a professional we can help Michael bridge the social and culture gap to be able to interact more with his peers by insuring him that it is ok to make friends, and use the resources that he has been, his hearing aids if he has them are great to help with hearing to understand speech, because he is developed mainly through the auditory channel, even if it is delayed. As professionals we could give Michael step by step directions to follow and be able to do observation on Michael to measure his progress to date. As the professional working with Michael I would encourage him to wear his hearing aids if he has them and start a reward program for him for following the expected behavior, also remember to give him positive reinforcement, if he hears the positive reinforcement and the encouragement  and excitement in your actions then he will want to follow also because kids want to make their elder happy. As Michaels parents they could encourage play dates and interaction with other people his own age. If they are not planning on having any more children and Michael is going to remain an only child maybe the family can get some cousins to come and play on regular basis as well as children from around the neighborhood. Since he will be starting Kindergarten in a month the teacher in the class room could modify some of the learning lessons that she will teach to make them more on his level, also the teacher can communicate with all the others that are involved in the child’s life and come to a plan that is going to work for everyone and it can be used all around the board. All children that are exceptional need to be evaluated for their progress, I would have the teacher make some tally marks for the behavior for the day and let the child work towards a prize once that is completed I would ask the teacher to add the tally marks and make it so that it can be observed in a percentage for example out of 10 tries to hear and responds to the word that was said Michael will wear his hearing aids for 5 out of 10 trials, or 50% of the time if it is only 3 times out of the ten that Michael does this then it can be observed as 30 % of the time and it can be observed weekly and progress can be marked and measured to see what the progress would be. Also making use of all and any reinforcements that can be used will help the child to be successful. Since it is known that the child has a hearing problem it should be given out at first notice and then the child can sit up front in class and since most teachers have seating charts for their classroom it would not seem unusual for the child to be placed up front if others ask what the issue is later then it with consent the teacher can say something to make it known to the class, some children will tell anyway but as the teacher in the classroom she should encourage the other children in the classroom to interact with Michael so that he can be excited to go to school. And most important of all enjoy his learning and school experience. As we learned with Michael people that are deaf or blind lose some of the most important things in life and it is not an easy thing to overcome the person can live a wonderful life but needs the encouragement and support to do so. So for Michael our 5 year old male that is hearing impaired and has trouble with his speech with the help of all the resources that are available and  coaching Michael can grow to be a very smart male later in life. Introduction Initial corporate governance developments in the UK began in the late 1980s and early 1990s in the wake of corporate scandals. Cadbury Report (1992) defines ‘Corporate Governance as An Act of governing by the board of Directors†. Financial reporting irregularities led to the establishment of the ‘Financial Aspects of Corporate Governance Committee’ led by Sir Adrian Cadbury. The resulting Cadbury Report published in 1992 outlined a number of recommendations around the separation of the role of an organisation’s chief executive and chairman, balanced composition of the board, selection processes for non-executive directors, transparency of financial reporting and the need for good internal controls. The Cadbury Report included what is termed as â€Å"The Code of Best Practice† and its recommendations were incorporated into the Listing Rules of the London Stock Exchange. The Code was initially directed to the board of directors of all listed companies registered in the UK, but it is was not limited to only the listed companies as it also encouraged many other companies as possible to aim at meeting their requirements. Bringing greater clarity to the respective responsibilities of directors, shareholders and auditors will also strengthen trust in the corporate system. Companies whose standards of corporate governance are high are the more likely to gain the confidence of investors and support for the development of their businesses. The Hampel Report reviewed the progress of companies in responding to the Cadbury and Greenbury Reports and made some suggestions for improvement. The Turnbull Report addressed the important issue of how to implement best practice systems of internal control. The Report had set a deadline of 30 June 1993 for the beginning of reporting compliance with the Code. By this time 54 out of 66 reporting FTSE100 companies had complied  with the reporting requirement. The percentage of companies with combined CEO and Chairman of the board had declined from 25% to 15%. Within a year the percentage of FTSE350 companies with remuneration and audit committees had doubled and the percentage with nomination committees was rising. The result of all this activiti es is that UK corporate governance ranks as the most open and transparent system of any in the leading industrialised countries. The UK is now ranked ahead of the US in terms of the quality of the environment facing investors on the basis of the governance practices of the firms they are most likely to invest in. It was just like any normal day in the picturesque suburb of Massapequa, N. Y. It was in the middle of fall and leaves were scattered on people's front lawns. It was a completely ordinary Sunday morning with people either going to the shops or just casually lazing around on their verrandahs, everyone leading a deceptively offhand style. But all was not the same for the Rediros. This family were living descendants and a modern replica of the infamous Gambino family. Amongst the Rediros' neighbourhood they present themselves differently and carry out their lives in a normal manner around home and try to show the residents they are average people living an uneventful, debonair life with a nonchalant attitude to life. Most of the criminal activity comes from the father of the family, Al Rediro, he was so high up in the ranks of the elusive New York crime family he practically had his own army there was talk from amongst his father's friends that Al Rediro was to become il capo di tutti cappi, the boss of bosses, godfather and chosen heir to Paul Castellano. Al Rediro made his money from owning various strip joints, bars, nightclubs, drug dealing, money laundering, prostitution and owning New York's biggest illicit stolen car ring. Carlo was one of the many people visiting the shops that day; he popped along to get some bread and milk. But once he returned he was in for a shock, a very big shock. He encroached his six bed-roomed well furnished house walking up the drive to notice the front door open; it all seemed a bit peculiar to Carlo for a neat family, leaving there front door open shows means there showing the neighbourhood into their lives. He could view through the illustrious and grand front door and immediately spotted furniture upturned and out of place; the house looked surprisingly out of touch for the neat family. He wondered around the ground floor and looked around, â€Å"hello, anyone there† he asked. He stood there looking helpless with a great big white, blank face as a sign of fear and desperation, wishing for a member of his family to reply. Silence. Carlo began to step around in his hallway cautiously watching where his feet landed amongst the furniture left wrecked around his house. He found nothing of use to him in finding his family, so he backed up against one of the walls and threw a book through the living room door on his left side, to show he's there in case anyone was in there. Then carefully, very slowly, he gently moved his head so only one eye could see in, he saw nothing wrong but could only see half of the room. Then suddenly he plucked up enough courage inside him and quickly jumped in to witness the tragic scene of his sister Ella lying with her back down on the sofa. That was the sofa the family would sit on and enjoy nights in and sing songs with the rest of the family, but now this time it was very different for his sister, Ella had been brutally stabbed in the back, the claret-red blood was all over her back saturating the back of her shirt, it was dripping off her nose from her face and staining the sofa all over. Carlo stood there about ten yards from her body standing completely shocked and dismayed. Carlo was now engaged in an emotional outburst crying out loud as any other 12 year old boy would seeing a dead body, especially his sister's, he began to sprint aimlessly around the house not having a clue what to do. Carlo dashed in and out of every room on his ground floor of his three storey house hoping to find a member of his family alive, but there was nothing to be seen, just more wreckage of their once beautifully kept house with beautiful dicor. He sprinted through his hallway, past the front door he arrived through and tore it up his staircase screaming for aid, help and to see his family. Once at the top to see he saw straight across the landing, his worst nightmare had just got even worse, he had now found his mother hanging from a noose in her bedroom doorway. The coldest part was when Carlo unexpectedly witnessed a gruesome sight of blood stemming profusely from her stomach. She had been riddled with bullets from an automatic gun across her torso to make sure she never survived her slow death of hanging. Continuously crying, Carlo was becoming more and more desperate by the minute. He carried running in and out of the bedrooms and had noticed Robbi, Carlo's nineteen year old brother had his window wide open. Carlo ran across and by now had learnt to expect the worst. He looked out everywhere to witness nothing wrong but peered his head out a bit more to look straight down and see Robbi square on the patio lying cold. Courageously he vowed to continue looking for his last possible living family member, his father, Al. Undoubtedly this attack on the family was from someone who knew Al and were never going to leave him be they were certain to chillingly kill him just like every other member of Carlo's family. In utter desperation Carlo continued searching. He had combed the whole house, apart from the basement where Carlo knew Al spent a lot of time. He sprinted down the steps to see fresh blood still wet on the floor. He followed one end of the trail to lead him to a laundry basket; quickly he opened it and straight away recognised a body but no head. He immediately followed the other end of the trail of blood to stand in front of the washing machine; he looked through the transparent screen to see his father's head knocking around. Carlo, screaming senselessly in a fit of anger, he was completely deluded as if he was in his worst nightmare, he knew he'd hit rock bottom. Without any hesitations he ran straight up the steps and across the hallway and exited through the front door and ran down the block heading for the park where he plays with his friends after school. But Carlo bumped into a man he recognised but hadn't introduced himself ever before, Carlo recognised him from the trips he had made to the grocery store throughout his childhood. The man introduced himself as Zack and immediately could tell something major had gone on in Carlo's life very recently. Carlo described to him the situation he was in and they wondered back to his flat and from then on they hit it off, they had a lot of things in common and they were more or less from the same background, Zack felt for Carlo and Carlo moved in with him. That night they watched the news and discovered the attack was an event waiting to happen amongst the underworld for many weeks. Ever since the trial of Vince Vandetti, Al de Miro had been waiting for it. Al de Miro had committed the biggest unwritten rule for anyone in the underworld, grassing. Al testified against Vince in his trial for the numerous money laundering arrangements he had made. Al wouldn't have done it but he gave in to the Courts, he was gong to risk jail for all his illicit businesses had it not been for all the deceitful and corrupt judges. They had struck a deal with Al, he testified and he would get immunity. Carlo had learnt everything now, everything was fitting into place but couldn't forget his father, his father had completely let the family down. For the next few weeks Carlo settled into Zack's two bed-roomed apartment. Together they worked well; they bonded to the extent that Zack became his legal guardian. But one day Carlo noticed something that would turn his life around – again. Zack was cleaning the barrel of a handgun. Carlo shocked with disbelief thought his days of lies and crime were over questioned Zack, â€Å"Why have you got a gun? † Zack replied calmly â€Å"this is my job Carlo. I'm a cleaner; I get paid to do this†. Carlo was in an outrage. â€Å"Did you kill my family? † Zack told Carlo he would never do such a thing because he has two rules:- 1. No women 2. No children He also told him he doesn't know who killed his family. Carlo is a soloist who does jobs for the Mafia and proclaimed he has never had links with Vince Vandetti. From then on Carlo agreed with him and believed him, he changed also as a person and began to train with Zack for the skills he needed, Zack became an inspiration and Carlo declared he wanted to be a cleaner as well. After over 9 months of intensive training and expert tips Carlo turned into a one time 15 year old with a scrawny figure to a muscle bounding, flesh hungry assassin. They were beginning jobs together and by the age of 17, Carlo had killed 12 men. There was one job though that the Mafia gave Carlo and Zack, this was thought to be a good incentive for Carlo, it was to eliminate Vince Vandetti from life. The job was also aimed to take out the whole Vandetti family, Vince had got off lightly as some of the charges against him were dropped for a lack of evidence, this meant he was only in prison for two years. Once out Vince and his own family had severed links with the Mafia as Al de Miro was much loved within the Mafia. Since out of prison Vince grew links down south with the Columbian Mafia. So for Zack and Carlo to do their job they went there, they posed as drug dealers and arranged a meeting with him at a casino. However, they had other things on their mind and set up a post on the roof of a building with their sniper and night-vision scope. They found him dressed in a long dark grey jacket on the crowded street, the setting was perfect as they would never be caught as everyone would be panicking, then they aimed at him and Carlo fired with pleasure. They decided between themselves that he was definitely dead quickly before a mass crowd occurred around him; they fled the scene and got on the next plane to New York. All was well, they touched down safely and got on with the rest of their lives and carried on doing more jobs. Three months later word must have spread, Carlo and Zack had been found out and on a normal trip to the grocery store they were both wrestled by two men into a dark alley and executed in the head as part of a reprisal. They paid the consequences for just one of their many jobs, people said Carlo should have given up and left the New York crime scene since the loss of his family and set up life elsewhere and continued with the rest of his childhood but he didn't and ultimately paid the price. But people who remembered Carlo and Zack, the only people who can consecrate their memory, were fellow callous minded members of the Mafia from the New York underground crime scene turned up to their joint funeral to give their condolences to two very loyal colleagues killed on the job.

Should Alternative Dispute Resolution be Made Compulsory? Introduction. It is a sad fact of life that disputes can and do arise from even the most trivial incidents and activities. They are always totally unexpected and usually highly predictable.[1] For a long time, people have been worried about civil litigation. It is costly, time consuming, worrying and takes a long time to decide.[2] Alternative Dispute Resolution (ADR) is a term which refers to various procedures developed in the United States over the last 15 years or so in an attempt to overcome some of the weaknesses in the litigation and arbitration processes.[3] This essay will look at Alternative Dispute Resolution in England. I will start by looking at the concept of Alternative dispute resolution. I will briefly examine Lord Phillip’s speech delivered in India on 29 March 2008. Finally, I will give my views on whether Alternative Dispute Resolution should be made compulsory in England and the problems that would be encountered if Alternative Dispute Resolution is made compulsory in England. Alternative Dispute Resolution A focus on rights has played a significant part in the transformation of Western political culture from the harmony ideology of feudal societies in to 20th century participatory democracy. However, 30 years on from the birth of the civil rights movement in the United States, there are those who now express scepticism over the achievements of a rights oriented public culture.[4] As a consequence, some now propose a rethinking of rights ideology, as both a method of dispute resolution and a definition of social relations, and the development of alternative process for dealing with conflicts and claims.[5] Such strategies are generally described as offering alternatives, since adjudication according to rights remains the formal approach to dispute resolution in the west.[6] In common law jurisdictions, conversation about alternatives to litigation began to take institutional shape from the early 1980’s, in a range of disparate experimental procedures sharing the common label ‘Alternative Dispute Resolution’, with its universal acronym ADR.[7] The relationship of this growing complex of practices to lawyer negotiations, litigation and adjudication is far from straight forward. Some of the innovations taking place are directed towards speedy settlement of disputes between litigants without the involvement of lawyers, others appear to be implicated in, and are indeed extensions of legal practice, while others appear as supplements to, or modifications of court process.[8] The English Legal System is based on the adversarial system of litigation. This means that both sides to a case separately prepare their respective submissions and then arrive at court and participate in a quasi-gladiatorial contest until the tribunal of fact (in civil trials this usually being a judge) pronounces the winner.[9] In recent times, there is now been an acceptance that alternatives to the adversarial system of justice may be appropriate due to the high cost involved in the adversarial system of justice. One of the easiest alternatives to implement is to encourage disputes to be resolved other than by recourse to litigation. This has led to the establishment of Alternative Dispute Resolution (ADR).[10] Since 1990, many British lawyers, have taken an active interest in ADR, as a means of avoiding the public and private expense and the private pain of litigation.[11] The increased importance of ADR mechanisms has been signalled in both legislation and court procedures. For example the Commercial Court issued a practice statement in 1993, stating that it wished to encourage ADR, and followed this in 1996 with a further direction allowing judges to consider whether a case is suitable for ADR at its outset, and to invite the parties to attempt a neutral non-court settlement of their dispute.[12] In cases in the Court of Appeal, the Master of the Rolls now writes to the parties, urging them to consider ADR and asking them for their reasons for declining to use it. Rule 26.4 of the Civil Procedure rules (CPR) 1998 enables judges, either on their own account or at the agreement of both parties, to stop court proceedings where they consider the dispute to be best suited to solution by some alternative procedure, such as arbitration or mediation.[13] There is no universally accepted definition of ADR. The phrase ADR encompasses a range of procedures other than litigation which are designed to resolve conflicts. ADR processes include negotiation, mediation, conciliation, expert determination, adjudication, and arbitration.[14] Alternative Dispute Resolution or ADR may be defined, ‘’as a range of procedures that serve as alternatives to litigation through courts for the resolution of disputes, generally involving the intercession and assistance of a neutral and impartial third party. In some definitions, and more commonly it excludes all forms of adjudication.[15] The Department for Constitutional Affairs defines ADR as , ‘’ The collective term for the ways that parties can settle civil disputes, with the help of an independent third party and without the need for a formal court hearing.[16] There are three principle forms of ADR. Arbitration, Mediation and Conciliation. Some commentators argue that ADR can be divided in to two classes, those being adjudicative and consensual.[17] The former is called arbitration, and it is quite similar to court proceedings and this has led critics to ask, if there is anything alternative about ADR.[18] Four goals of ADR are : To relieve court congestion, as well as undue delay and cost; to enhance community involvement in the dispute resolution process; to facilitate access to justice and finally; to provide more effective dispute resolution.[19] Lord Phillip is a staunch supporter of Alternative Dispute Resolution. I believe that he wants ADR to be made compulsory in England Conclusion. Alternative Dispute Resolution no doubt has many advantages. There is a chance that you may quickly resolve your problem and you may be awarded compensation. The procedure is less formal court proceedings. In some cases, the decision may be binding on one of the parties, but not on the other party, thereby leaving one party free to pursue the matter through the court if he wishes. Alternative Dispute Resolution is usually much cheaper than going to court and the procedure is confidential. ADR will be difficult in disputes between more than two parties, where the parties have not already contracted for a consolidated arbitration and the parties will not agree to arbitration, going to court is potentially the only way of getting interlocking disputes resolved by the same tribunal.[20] A party that is proposing to enter a number of related contracts should particularly bear this situation at the drafting stage. There are two specific aspects to the matter. First, the related contracts should provide for an identical scheme of dispute resolution otherwise that party may find itself involves mediation or arbitration or litigation depending on which other party is involved.[21] Secondly, the drafting must address the need for multi party proceedings, and establish a back to back set of contractual obligations for this purpose. A difference in the powers at different levels will make the mufti-party proceeding very difficult to conduct.[22] If these two aspects of the matter are not addressed, the parties will be better off, with litigation as the fall back method of dispute resolution.[23] Where a number of actions raise substantially similar issues, such that a decision in one of them will probably enable the parties in the others to compromise their dispute, litigation is likely to be preferable[24].
